Warranty of Physical Fitness
The member warrants that he/she is in good physical condition and
has no disability, impairment or ailment which would be adversely
affected by participation in a physical conditioning program or by
use of the fitness center’s facilities or services. ProFitness urges all members to obtain a physical examination from their
physician prior to the use of any exercise equipment or attendance
in any exercise class.
Waiver of Liability
Member shall participate in physical conditioning programs and/or use of the fitness center’s facilities, services, or equipment at his/her
risk. ProFitness shall not be liable for any damages or personal injuries sustained by any patron, in on, or about the premises of ProFitness, from any and all claims, demands
or causes or of action, including, without limitation, any claim for
personal injuries arising out of use of the facilities, service or
equipment, or arising out of the negligence of ProFitness,
it’s owners, affiliates, agents or employees, or any other persons at
this fitness centre.
Personal Property and Valuables
ProFitness shall not be liable for the loss of theft of, or
damage to, the personal property of any members or guests.
Guests Policy
Members may bring their friends or relatives for guest visits. Guests
are allowed during staffed hours and pay a guest fee of CI$15.00
per visit. Guests must
present identification at time of visit and sign a waiver. Any member found providing unauthorized access to the facility to another person will result in a $75 fee being levied on their account. No Exceptions. No access will be given to the facility until this fee is paid and we reserve the right to charge any payment method on file for any outstanding fee.
Personal Training Policy
ProFitness offers in-house personal training. No soliciting or personal training service is allowed. All training fees are collected
by front desk personnel and are made payable only to Universal
Fitness Ltd. The waiver or liability also applies to this service.
Transfer and disabled policy
All Memberships are Non-Refundable.
Annual memberships are transferable and they may be sold or given
away as gifts. The incoming membership must be of the same
membership classification as the departing membership. Spousal
memberships, individual memberships, student memberships.
There is CI$75.00 transfer fee per person. The new member will
take over the monthly payment – if any, and pay no enrollment fee.
The written notice or transfer must be given 30 days prior to the
said transfer.
Annual monthly billing Authorization
The membership fee is payable in equal monthly installments and is
automatically billed to your credit authorization on the designated
day of each month for 12 consecutive months. If your account
becomes past due for more than 60 days, your contract will be
accelerated and the full balance owing will be due immediately plus
a CI$20.00 late fee. After the initial 12 months, the membership may
be renewed without an enrollment fee if the membership does not
exceed beyond 30 days of expiration date. To terminate this
membership, the member must provide a 30 day written notice and
pay a cancellation fee of CI$125.00
Month to Month Billing Authorization
An enrollment fee and 1st month billing is rendered on the date of
sign-up. The membership fee is payable in equal monthly
installments and is automatically billed to your credit card
authorizations on the designated month to month until terminated
by members with a 30 day written notice. Monthly billing will cease
after 30 days have passed.
Renewal Policy
Annual monthly billing memberships that lapse for more than 30
days, are subject to a new renewal monthly rate upon renewal.
Month to month billing memberships are subject to full enrollment
fees and new monthly dues. Management reserves the right to deny
renewal to any previous member at any time for any reasons.
Miscellaneous Fees and Charges
Member agrees all charges for pro shop, card replacement, closing,
etc must be paid at the time of sale. Members can charge items from
the pro shop up to CI$100.00 subject to credit approval.
Members agree that they will be charged $15 admin fee for removing equipment without replacing it after workout.
Sign In Procedures
Members are required to show their membership card to the
receptionist or activate during card reader at door. Guests of members and members using the fitness
centre must sign in at the reception desk on each visit. Members
agrees that use of the membership card by anyone other than the
person named herein is prohibited and the card will be confiscated.
Expulsion may result to the card owner with no membership refund.
Lost, stolen or mutilated key FOBs must be replaced and a CI$20.00
fee will be assessed
I hereby grant ProFitness permission to use my
likeness in a photograph, video, or other digital media (“photo”) in
any and all of its publications, including web-based publications,
without payment or other consideration.
I understand and agree that all photos will become the property of
the ProFitness and will not be returned.
I hereby irrevocably authorize ProFitness to edit,
alter, copy, exhibit, publish, or distribute these photos for any lawful
purpose. In addition, I waive any right to inspect or approve the
finished product wherein my likeness appears. Additionally, I waive
any right to royalties or other compensation arising or related to the
use of the photo.
I hereby hold harmless, release, and forever discharge the ProFitness from all claims, demands, and causes of action which I,
my heirs, representatives, executors, administrators, or any other
persons acting on my behalf or on behalf of my estate have or may
have by reason of this authorization.
