Terms and Conditions for Payment Plan Agreement
By opting to establish a payment plan with Pro Fitness Gym (“the Gym”), you (“the Member”) agree to the following terms and conditions:
1. Payment Plan Setup
1.1. The Member must provide valid payment details to initiate the payment plan. This constitutes a formal promise to pay the outstanding balance.
1.2. Payments will be automatically processed on the agreed-upon dates unless otherwise arranged.
2. Payment Methods
2.1. Payments may be made via the payment details provided during setup or in cash at the Gym before the scheduled payment date.
2.2. If the Member intends to pay in cash, they must do so at least one (1) business day before the scheduled payment date to avoid automatic processing.
3. Acceleration Clause
3.1. Failure to complete the payment plan as agreed (e.g., missed or delayed payments) will result in the immediate acceleration of the full outstanding balance.
3.2. The accelerated balance will be due and payable in full immediately.
4. Legal Fees and Collections
4.1. The Member acknowledges and agrees that failure to satisfy the accelerated balance may result in legal action through the Cayman Islands Summary Court (Small Claims Court).
4.2. The Member agrees to cover all reasonable costs and legal fees incurred by the Gym to recover the outstanding balance.
5. Non-Refundable Commitment
5.1. By agreeing to this payment plan, the Member understands that payments made toward the balance are non-refundable.
6. Communication and Updates
6.1. The Member must notify the Gym immediately of any changes to payment details or inability to meet scheduled payments.
6.2. It is the Member’s responsibility to ensure payment methods remain valid and up to date.
7. Agreement Confirmation
7.1. Clicking the payment plan link in the email and submitting your payment details constitutes acceptance of these terms and conditions.
7.2. The Member affirms that they have read, understood, and agreed to these terms as legally binding.
